Beware of Travel Guard Canada regarding baggage theft insurance

One of our bags was lost between Canada and Miami, and we did not get it back until the third day of the cruise. NorwegianGuest Relations were fantastic and did a lot to help us track down the bag andget it to the ship. When we got the bag we were not aware that some items were possibly missingfrom it until one day later after we had left Mexico. We only knew for sure the items were missing when we got back home and could confirm thatwe had actually packed them.

 

The travel insurance company we used, Travel Guard, wereabsolutely awful and callous. We paid $445 for our policy with them and yet they deniedour claim for $500 for lost clothes and an old camera mainly because we did not file apolice report We were absolutely honest withthem about our loss. We explained why we could not have filed a report in Mexico and that we tried to file apolice report in Canada on our return. Canadian Police declined tofile a report as we could not prove the items were lost in Canada. The Travel Guard agent said Ishould have told NCL but the stealing was nothing to do with them. I understand that we did not comply fullywith Travel Guard’s demands but we made a strong and logical case. A decent company with their own longer terminterests would have given us the benefit of the doubt.

 

 

They are however paying the $100 for our lost baggage claim.

 

 

This is to warn readers that although Travel Guard were legally within their rights to deny us, do not expect them to show any sympathy or tolerance when it is impossible to comply with every detail of their rules

I hear you, I understand what you are saying, and I have some level of sympathy for you.

However, the insurance company is not in business to pay claims based on a good sob story.

Your problems would not have ended if you had a police report. The problem would have continued with their requests for original receipts of items lost, misplaced, or stolen.

Just one other thought, you might check with your homeowner’s policy to see if it might cover the loss. But again, without receipts or photos, they will likely limit your loss to a very depreciated value.

OP might also want to check for any coverage they had with their credit card that they purchased the trip with.

Again though, you still have pesky burden of proof.

I'm not sure about the rules in Canada but here in California IT IS AGAINST THE LAW for a travel insurer to pay a claim that is not 100% supported by the wording of the policy and the proof of loss presented by the policyholder. Paying a claim based on "Sympathy" will put their license to do business at risk. They're heavily regulated and the wording of the policy is registered with the state and the state expects them to abide by the wording in ALL cases. They have no alternative but to deny the claim based ion the plan wording -- this is from the Travel Guard plans marketed in CA and probably identical to the plans marketed in Canada:

 

"Baggage and Personal Effects Proof of Loss: TheInsured must: (a) report theft Losses to police or other localauthorities as soon as possible"
