Like I said, drama much.  Nothing happening is an impasse.  No one complains when the media speculates about hung juries.  1 out if 5 Federal Bureaucrats can probably recognize that.

Absolutely wrong. They had been meeting with the mediator just prior to the press release coming out from the Governor’s office. Speculation is one thing. An outright claim of mediation failure is another. You can spin it however you like until the cows come home, but it doesn’t change it.

Now that is drama.  Maybe you haven't noticed, or just don't believe, there is a world wide Pandemic going on.  Therefore, we, living in a free country, have to recognize that there need to be temporary changes in order to protect the people in this free country.  It is not any type of grand conspiracy to turn this country socialist.  Yes, there are people that want to do that, and they tend to see the reality of the Pandemic, but actually one thing has absolutely nothing to do with the other.  In reality, this pandemic has been politicized, mainly by conservatives, which is the root of the problems we are having now.  I understand not liking big government, but don't take that to mean everything the Government says to do is bad.  Which is exactly what has happened.  I think if the CDC came out with a study that said breathing was good for you, there would be an incredible number of people that would try to hold their breath.

That doesn't change the rules of Mediation.  They are VERY clear.  Neither party can say anything about the mediation, only the Mediator.  All Judges enforce this very strictly (Federal, State or County).  There is no spin, it doesn't matter what was said.  The mere fact that anything was said is actually grounds for sanctions, as the Judge made clear.  On this, opinions do not matter.  This is very real and clear cut.

I was responding to boatseller and was referring to his spin on the Governor’s statement. I agree with you 100%.

The warning by the Judge was due to the Governors' office (not the Governor or counsel) release the 'fact' that "the mediator declared an impasse" (which is reported to the Court and/or the Parties).

 

Clearly they shouldn't have done that and it was also unnecessary; as it would have been widely known as the date passed.

 

They did not release any of the discussions by either side during mediation or comments, questions, etc. by the mediator.

 

The excited reaction and depiction to this is akin to the MSM reaction today to the 2 positive cases on Celebrity.  Over the top, expected and just what it is at the current time.

 

This will be challenged in reply with no evidence. 

 

It is clearly inconvenient.  The same legal 'experts' that said the case was a total WASH for Florida and wouldn't see the light of day - were wrong.

 

Oh well, pro bono; you get exactly what you pay for.

It wasn’t a ‘fact’ that the mediation was at an impasse.  THAT is what caused the upset in court. And the “excited reaction and depiction” runs both ways. Clearly this is inconvenient for some.

Challenged in reply?  What will be challenged?  The court’s admonition? There is no appeal on that. 
 

And your repartee on “pro bono” legal commentary is anything but clever. There has been speculation about the case and I don’t believe anyone ever said the case would not “see the light of day”. There has been no judgment in the case as yet, so no one is “wrong”.

I don't know if true but I have read that some of the first in the trials have received a 3rd shot.  Any truth to it.  I guess that year is coming up for some

I was a Mediator for many years.  In a case this important, people have n idea what is going on behind the scenes.  Even if the Mediator declared an impasse, he could still be working behind the scenes.  That is why any party that does a press release about a Mediation may find themselves making the Judge very unhappy.  Mediation has helped clear their dockets, so they protect it very strictly.

The opines were that Florida (Plaintiff) wouldn't even get "to this stage;" figuratively; meaning Florida 'had no case at all.  Yet, they are still standing as the Defendants "dig in their heels," with no allowance for negotiations.

Back on topic...we are on the 6/26 AoS sailing and received an e-mail update from Royal today. Vaccinated guests on our cruise now have to have a negative pcr test within 5 days of arriving in the Bahamas, but no test at the pier. For our 7 y/o son, he will also have to have a negative pcr test 5 days out and an antigen test at the pier. I do not see where (for vaccinated guests) Bahamas have changed their requirements,  so the new pcr test for vaccinated guests appears to be solely a Royal requirement.
