     I read that at the time it happened also... all sources said that originally all Anello said was 'I dropped her," "I dropped my baby." The doctor was down on the pier running to the baby, he couldn't have heard anything Anello said up on the 11th Deck. The family was separated for questioning.  After the family got back together, the story changed to "I thought there was glass." Several days laer, it beecame "I am color-blind so I couldn't see there was no glass."

     

    I wonder if there is eye-witness testimony that just hasn't been released yet? And in Anello's deposition for RC, all they have to ask is "Did you plead guilty to negligent homicide in the death of Chloe Wiegand?" And it should be over and done with.

  2. Involuntary Manslaughter

    Involuntary manslaughter is defined as an unintentional killing that results either from criminal negligence or the commission of a low-level criminal act such as a misdemeanor. Involuntary manslaughter is distinguished from other forms of homicide because it does not require deliberation or premeditation, or intent. Because neither of these mental states is required, involuntary manslaughter is the lowest level category of homicide.

    Criminal Negligence

    The first type of involuntary manslaughter occurs when a defendant negligently commits an act that results in the death of another. The level of negligence required for involuntary manslaughter is higher than normal civil negligence and requires that the defendant have acted in a very unreasonable manner. The exact language used to describe this negligence standard varies by state, but many refer to it as “criminal negligence” or “gross negligence.” State laws also vary as to whether the defendant must have been aware that his conduct was grossly negligent. In some states, the defendant must have known that his conduct was a threat to others, while other states consider whether the actions were objectively negligent, without regard for the defendant’s own perceptions.

    It is important to understand that criminal negligence does not require that the defendant have committed an unlawful act. Rather, it criminalizes both lawful and unlawful acts that are committed negligently. For instance, although driving a vehicle is legal, driving that vehicle in a reckless manner may constitute criminal negligence and, if death results, lead to a charge of involuntary manslaughter.

    Criminal negligence can also result from a failure to perform an act that the defendant has a duty to perform. Where a parent has a duty to take care of and protect a child, but the child dies when she is left in the car on a hot day, the parent may be culpable for involuntary manslaughter. Another example would be a tour operator who fails to advise his passengers of the proper safety protocols, resulting in the death of a passenger. This tour operator has failed to perform his duty, resulting in criminal negligence.

     

    He should have pled out, accepted long-term probation. You have to wonder what his attorney really thinks and has recommended, and are they in so far, because of the civil case, that no one can back out.  Some earlier poster said that the mother did not like the fake-step-grand-father based on comment they read on her Facebook page, but which have mysteriously disappeared.

  3. In one of the photographs I saw of Winkleman's re-enactors, it appears to make the situation more dire. The legal partner is standing sideways on the deck, in the bar window area, holding a measuring tape. His inside (to the window sill) arm is holding a measuring tape, and clearly his knuckles, and part of his hand, even arm,  are extending beyond where the window glass would be, with the tape stretched out to the railing. (I think they were trying to make it look farther than it was), but it really shows a man not stretching, just extending his arm, and being able to touch outside the window.   If he turned to full-face the window, it would be no effort or stretch to have the poor baby dangling outside.  This is Winkleman's partner in this picture.  It also shows the railing is above waist height.  We don't know what FSGP was trying to show Chloe that he had to extend her out the window, but from this angle, it certainly shows the danger of a one-arm grip with a squirmy toddler 11-stories above a pier.  It also clearly shows the difference in color from an open window and a closed window- the tinting sheet has a slight grid pattern to it. Seems this photograph alone would prove all FSGF's other statements false. But I'm not sure the judge cares about color-blindness, or hockey game window banging, or views from a dangle. I think the judge will be looking at the definition of negligence. 

     

     Definition. A failure to behave with the level of care that someone of ordinary prudence would have exercised under the same circumstances. 

     

     Optics not so good for fake-step-grandpa... so maybe that's why Winkleman is not sharing. It could make FSGP lose his case. And if he loses, it greatly impacts the civil suit.Image result for winkleman photos of toddler death on Royal Caribbean

    Every on-line cruise contract I have had to fill out (annually for 6-18 people) has a block to mark-off with each person's name, stating they would comply with all requirements of the contract. So it was on me to make sure they were aware of the rules-- boarding times, what can and can't be taken on board, safety precautions, etc.  So if I signed the contract, the responsibility was on me. Now, can they try to use this as a defense? Of course they will!

     

    That said- I just checked the "cruise contract" posted on Carnival and it said the cruiser must follow all safety precautions, attend all safety lectures and drills... but didn't actually say "Don't climb up on railings or lift children out the window."

Regarding the civil trial and not the criminal one (of which I think he is guilty of negligence- and he knew better because he signed the cruise contract that said not to climb on or over the railings)-- as I understand it, RC is trying to get the case thrown out because the accusation is RC  didn't follow safety codes. It would seem the step-boyfriend/grandfather is the one who didn't follow safety codes. It would seem the minute RC shows the signed client contract...and videos of any other signage forbidding playing on the railing..it would all be done, put a fork in it.

     

    It would be interesting to see if any of the family members have ever cruised before...

Amazing that neither the attorney for the family, or the attorneys for RC have mentioned that the grandfather had to sign a guest contract acknowledging no climbing on or over any barriers, railings, etc.  And I have seen cautionary signs on RC before, just not necessary to have it on every single window.

     

    And if there are really 11 other camera angles, why would RC need to release them to the public? Wait til the trial, and see even more evidence of stupidity.  I feel badly for the entire family, and I know when something bad happens and you feel helpless, you can take it out on everyone. By now, the family should have dropped the suit (IMO) and all be in counselling to deal with the step-grandfather.

  7. I'm a sun worshiper....really bad when younger, and love my Caribbean cruises... but last month had half my right nostril removed due to basal cell cancer, and about 38 other squamous cell spots removed, and a lot more of them freeze-dried!!

     

    I  use Lancome, and have sun block in my moisturizer, separate SPF50 as just a sun block, and there is more sunblock in my make-up. Unfortunately, someone last night told me my face looked chalky. So I'm going to start tsting some others

     

    I'm still looking for a good body sunblock, even though I now always wear long sleeves. And a hat. And big sunglasses.

  8. Love my Rothys. Have 3 pair, wear them all day, then even to do my steps at the mall. Love that I can throw them in the wash (although they do 'thunk' in the dryer.)

     

    Am considering wearing them sightseeing on our European cruise next July

    2. Yes-unfortunately too many smokers try to sneak puffs in their room on or their balconies. I have had a suite or a balcony cabin for my last 12 cruises, and I can smell it wafting over the balcony dividers. If people just didn't try to cheat and smoke in non-smoking areas, it would be totally different.

     

    My friend owns a ServPro (Like it never happened), and he said there is a reason for non-smoking rooms to stay non-smoking, and it's more than emptying a few ashtrays. The smell, and the toxins from the smoke linger and settle into the upholstery, the curtains, the rugs etc. Should an ultra-sensitive person stay in a room where someone snuck a puff, they could become sick.

     

    My mother smoked 2 packs a day. My in-laws smoked 2 packs a day (each). When they passed, the amount of clean-up required to get the tars and nicotine (which is a toxin) off the walls and the paintings, and furniture was amazing-- there was a film no one had noticed on the windows, all the fabric things had to be destroyed.

  10. May I ask what your bid was for the AFT? Poor, Fair, etc?

     

    We bid $150 over the minimum for an Aft Suite, which is still over $1000 less than the book price. My travel agent put in the comments that we preferred the AFT to the Forward suite. (She had the Forward Suite and said it was very loud and windy- and in Alaska, got chilly inside)

     

    We bid $100 for the mini-suite and the balcony rooms, which was about $50 over the minimum.

  11. We are 71 days out, and normally have 5 cabins all in the same immediate area, and with the upgrades, that won't be guarenteed. Doesn't matter! I bid for an aft-suite for my husband and I, a mini-suite for our daughter/husband, and upgrades from 2 interior rooms to 2 balcony rooms for the single sons. I bid a fair to middling amount over the minimum, on the advice of my travel agent. So we're just in the waiting phase.

     

    I just hate not having all my paperwork done, bag tags printed, everything else.

  12. Oh, I start way early too--- with a spreadsheet where I list which item, appropriate lingerie for that item, shoes, , etc... so I can color block, mix and match...and most important remember everything!!

     

    My husband and son (son is 37) start packing the night before. Washing machine is going full blast, son is trying to stick things in my suitcase... there's a lot of "did you get me..."

     

    So funny. But in 25 years of cruising, I have never forgotten anything except sunglasses, whereas, they have been known to hit kmart on every Caribbean island!!

  13. This is a great service, and I have used it on RC, Carnival and NCL in both Ft Lauderdale and Miami.

     

    However-- it only works on certain airlines, and the flight must leave after a specified time...like in Miami, the flight had to leave after 11:45, I think. So check the flight departure times carefully.

     

    And you do end up paying like $20 per bag. But so much easier than slepping off the ship and to ground transportation, and checking it in at the airport.

On Embarcation Day, I took advantage of the special pricing..had this 90 minute thing where first you get dry brushed, then you are covered with a mushed seakelp paste, and wrapped in plastic wrap, then weighted blankets, then lowered into warm water to sweat out the toxins. Then you shower off the sea kelp, then get a massage...pure bliss!!

     

    I also like the Thai poltice massage. These herbal dumbbell shaped things filled with herbs is wetted down and heated. They do your pressure points with these (very) warm poltices, then along the muscle patterns, then the oiled massage.

     

    Also try the reflexology!
