  1. Like I said before Chloe was perfectly safe looking through or banging on the lower glass until the Grandfather got involved.

She was too little too climb up on top of the railing herself.   Left alone she would still be here.

I have been on that class of ship 3 times and there is no way you wouldn't know those windows were open.

Not a lawyer, but the crime scene is divided between the ship where she fell, which is not US territory, and the pier where she actually died, which is, so this is another sticky international law issue, I would think.

And by the time they figured it out it may have been too late to test for Alcohol.

With respect to jurisdiction on a foreign ship in port, it does not completely fall under the jurisdiction of the port it is in, it is covered by the overlapping jurisdictions of the port and the flag state.  There is a lot of legal debate over the limits of port state jurisdiction over a foreign ship, and in most cases, international law and international trade law is applied, and the port state does not impose its jurisdiction on the ship except on matters "external" to the ship (pollution, trade, taxes, etc) or unless the "safety or well being" of the port are affected.  The death of a US citizen on a foreign ship in a US port is considered to be "affecting the well being" of the port.  Further, the US has claimed "extra-territorial" jurisdiction over certain crimes committed against US citizens on foreign ships while in international waters.

In this case since the death took place on the pier in Puerto Rico shouldn't they be able to apply all their laws?

  4. The may generally hold firm on the Credit.   By issuing a credit many of those who had cruise insurance can get their money back form their insurance and those people will probably re-book at a later date.  This means RC is still being paid for those cabins.  Those with credits definitely will re-book.

Now they may look at individual cases like yours and issue a refund.  It may take writing a letter to get a response.

By doing it this way they are essentially getting revenue from their passengers insurance companies.

  5. This is nuts!

If left unattended this little girl would of went up to the window under the railing just as she did looked it through it and possible banged on the glass as she did at hockey games.   Making it a safe environment for children.

For whatever reason that was not good enough for the grandfather.  He took her out of a safe situation and put her in a dangerous  one.    If he would of just watched her do what she loved to do at the hockey games she would still be here today.

This is 100% on the grandfather.

  6. Carnival ships always looked like the smoke was darker.  The Tail design shots the exhaust out to the side as opposed to being push straight up so it lingers more.  The smoke is spread out farther and moves vertical much slower.

Now the ships are changing over to various methods of controlling emissions.

  7. RC did a great job protecting the girl on the ship.  She walk up to the side and was perfectly safe.  She was safe.

Then an adult decided to pick her up and hold her over the structure that was protecting her.

The only thing they could do better is have an IDIOT test before boarding.

  8. In Portland it is about a 1/4 mile from the ship to the main road(Commercial Street) and then another 1/4 mile down Commercial Street to the where the shopping area, restaurants and wharf's start.  Commercial street is the road that runs along the harbor.  It is all flat.

In Bar Harbor it's only about 200 feet to town from where the tender drops you off.
