  1. That said, invasion of privacy isn't as clear-cut as "it doesn't apply if you're in public." For example, if NCL used the video to make a commercial and didn't clear it with the individual or remove identifying traits, ... .

you should read the NCL contract of passage

    see http://www.ncl.com/sites/default/files/Guest_Ticket_Contract_03_2014.pdf

    16. Use of Guest Likeness:

The Guest consents to Carrier's use and display of the Guest's likeness in

any video, photograph or other depiction for any purpose, commercial or otherwise, without compensation or liability of any kind. The Guest's consent extends to minors and other persons in the care and charge

    of the Guest.

Guest further agrees that any type of photograph or recording, in any audio or video format,of the Guest, other guests, crewmembers, independent contractors, concessionaires, guest entertainers

  2. Thank you for responding. It just seems to me this is something extra and NOT something the cruiselines freely provide. Its more like an ass kissing party and feel that them going out of their way deserves a little thank you. Not sure a $10 bill is going to break me especially for what I paid already. If Im setting money aside knowing Im going to lose it at Bingo or the Casino than I think I will go against the grain and just tip them myself. Thank you for your opinions

They are happy to provide its good PR. Who do you tip? The person who set up the party? The people who bring the coffee and the snacks? As others have said the serving people are part of the behind the scenes staff that are compensated by their salary and a share of the DSC. You are of course free to give anything you want but its really not expected and the group coordinator who sets it up is a salaried employee. There generally is not a bar tender and if you are paying for the drinks or part of the UBP they are already compensated. There is nothing wrong about leaving extra but its just not expected IMO.

  3. As others say a taxi is about $40.00 for up to 4 people(although it will get difficult for that much luggage. a car service like dial 7 charges a fixed fee and varies by car service.

see http://www.carmellimo.com for on line pricing Carmel says $30 from LGA to Manhattan plus there is a printable $4.00 coupon(not that I have used that myself).

Its also possible to get an express bus to the Subway(upstairs to the E) which will let you off a 1/2 mile at 50th street and eighth avenue from the pier (50th street and 12th ave)although I would not do that with any amount of luggage for $2.50 to $5.00 pp.

  4. these comments are on the accuracy of the Taxi section of his post. If you want you can send him a link to these, after all its you are vouching for the accuracy and his hard work. No one here disputes that only that some of the information is just wrong. If people look at his post on the NY Port, its helpful if it is as accurate as possible.

  5. That said T&LC suspended 5 our of the 6 Uber bases in NYC in January for non-compliance. If your base was suspended you had to transfer to the one that wasn't.

    ...

    FWIW

and reinstated the licenses the next day. The "non-compliance" was Uber refusal to turn over data demanded by the TLC when Uber refused there was laughter because Uber han't dealt much with the TLC. the next day they suspended the licenses. Uber then went to court but was told comply or stay suspended...and they worked something out with the TLC. The TLC uses the data to determine if the Limo service is in compliance.

  6. for those who don't know UBER is a company that uses a smartphone application to match cars and passengers. In the NY/NJ area they use the same car services that you can call on the telephone. Its ok and convenient. The problem arises when they impose what they call surge pricing-a surcharge as much as 300 percent when it deems a shortage

The cab/taxi fare from EWR to Bayonne is set by two different commissions Jersey City and Newark. The car services just follow that for the most part.

  7. Sid I'm also not happy with the taxi fare section. I met someone on my current cruise who had used the taxi fare finder to get an estimated rate from a Newark Airport hotel to Cape Liberty for about $27 and was unhappy when she was charged $55, which is a normal rate that others have reported paying.

the taxi fare finder is a mileage and NY City yellow cab rate computer application. Its almost always light on the actual charge(again IMO). Its almost always wrong in NJ where its mostly based on flat fares. Fares in NJ are significantly higher IMO than in NY City.

  8. the tolls across the bridges and tunnels to and from NJ are 9.75 off peak and more peak are with ez pass only. its 14,00 cash. this amount is the same for cabs or car services.-from to ewr to nyc.

within nyc the tolled bridges and tunnels are 5.33 with ezpass or 7.50 cash. ny yellow cabs must have an e-zpass. there are no tolls-or shouldn't be from either JFK or LGA`to the Brooklyn cruise terminal.

ny city yellow cabs are not required to take you from either JFK or LGA to the bayonne cruise terminal and if they do agree to the fare must be negotiated in advance and it isn't on the meter. they are required to take you to EWR...

  9. I have not looked thru everything but there significant errors in the taxi section.

as examples NY CITY yellow cabs use the meter from JFK to the Manhattan cruise terminal but it should always be the set fare of$52.5 plus the toll only if they use the midtown tunnel of $5.33 not the toll listed on most of the JFK/LGA runs.

The taxi info from EWR is also wrong

    see for example

    http://www.panynj.gov/airports/ewr-taxi-car-van-service.html

    http://web.mta.info/bandt/traffic/btmain.html

    http://www.nyc.gov/html/tlc/html/passenger/taxicab_rate.shtml

To/From JFK and any location in Manhattan:

    • Onscreen rate is ‘Rate #02 – JFK Airport.’
    • This is a flat fare of $52 plus tolls, the 50-cent MTA State Surcharge, and the 30-cent Improvement Surcharge.
    • Passenger is responsible for paying all tolls.
    • Please tip your driver for safety and good service.

  10. a lot of farms in Az? I think not. There are however cattle interests raising cattle on low charged US Government owned lands.

I don't want to get into a political discussion its OT. I just saw the McCain article and it was on topic.

Countries building the ships he cites are generally NOT low paid countries although some are. Most of the US private Ship building capacity has been used by the military since its shipyards closed(Brooklyn, Phily etc)

  11. Customs retiree here. I think there was a misunderstanding early in this thread. When a ship violates the PVSA, a mark is recorded on the Captain's immigration record, not on his Captain's License. Ask any cruise ship Captain the sort of questions he is asked when clearing U.S. Customs flying back from their home countries. They are almost always questioned on Jones Act and PVSA violations.

I've never seen it happen and it likely never will, but by law a foreign Captain could be deemed inadmissable to the U.S. for too many of these violations.

As I said way up above, NCL's foreign flagged vessels used to make a run from Hawaii to Kiributi to meet the requirements of the PVSA. Almost half of the time, the ship didn't make it for some reason(sick passenger mostly but mechanical reasons some times). It was I think 2 days each way. NCL ultimately agreed to pay a $1,000,000 fine and didn't get it back from the passengers. No NCL Captain was ever refused admission to the US for that reason.

I didn't say "some home office employees" don't meet the definition of not being passengers but I did cite to the quotes of what a passenger is. Payment or non-payment is not the reason but what they do is. Although its not on point here, the band on the Titanic was not considered crew for workers comp(equivalent) UK law purposes. see http://www.titanicuniverse.com/titanic-band-members/2927 I know where to go to look these issues up and the facts and the actual law and regs need to be consulted and considered.

  12. Wouldn't it be used in conjunction with your birth certificate to prove US citizenship when on a closed loop cruise? That doesn't mean it will be swiped, but two forms of government issued ID are usually required when there is no passport present.

? only one pictured government issue id. is required. the birth certificate is not an id. they won't swipe the dl to see its not suspended.they aren't tied into that system although they will ask homeland security if you are wanted. most states also issue an id that is not a license.

  13. When Noordam came to Boston from Fincantieri ship yard in Italy, she stopped in Boston for parties etc There were many home office cruise line officials and employees aboard and they sailed from Boston to NYC for the

    Who is a Passenger?

Generally, a passenger is any person carried on a vessel who isnot directly and substantially

connected with the operation of such

    vessel, her navigation, ownership,

    or business.

    See

    19 CFR § 4.50(b) and the

  14. .....

but I agree, the right answer is dd must make a choice, one or the other as I would NOT tell someone to consciously violate the law

    BUT

what if no one ever asked the question and dd just left and flew to the wedding? Someone going to jail? What if OP never HEARD OF Cruise Critic?

"Don't ask questions you don't really want to know the answers to."

"Sometimes it is better to ask forgiveness than permission"

    **********

OP: GO 'NOLES (2 kids, one a NOLE and one grad of BAMA ..... a football house here!)

I don't think its a criminal statute at all, although lying to the CG or the Customs people IS and can get you a year in jail if they want to get you! I could see it now what are you in jail for! I got off in San Franciso on a cruise ship and didn't back on!

one of the strange things in the law under the PSVA is that it doesn't apply to crew that regular operate the ship so they can get on and off when and where they like but not ship line employees who work in the home office..it does apply to them.

  15. this is called Coastwise Cabotage trading.

Its my understanding that the Jones Act covers cargo and is also worker's comp for Sailors.

    http://en.wikipedia.org/wiki/Merchant_Marine_Act_of_1920

    PVSA covers passenger ships.

    http://en.wikipedia.org/wiki/Passenger_Vessel_Services_Act_of_1886

The laws are similar in that limit who or what can be transported between two US ports.

I am unaware that they keep track of how many times a captain violates the rule. If so every NCL Captain that sailed from Kaributi from Hawaii surely would have lost their license as they missed it more often than not.

Besides the penalty of $300 per passenger paid by the cruise line and recovered by the passenger, the cruise line and ship could be barred from any US port for a period of time but that penalty has never been imposed as far as I can tell...although it might have been threatened. A penalty on someone who didn't violate the law but assisted is NOT authorized by the statute.

The penalty is imposed but may be mitigated when it was an "emergency". It was mitigated when the Carnival ship had to return to different port because of a loss of all power or when NCL's Dawn returned to Norfolk after being struck by a rogue wave(not a rouge one). Individual cases of medical emergencies are decided on a case by case basis. But a wedding probably won't qualify.

  16. We are sailing on Mother's Day this year. Does anyone know if there will be any problems coming in from Philly on the Lincoln Tunnel that morning? I know here there is a big Breast Cancer Walk- many roads closed in the Philly area ... Anything like that in NY that we should be concerned about?

Its rare that its a problem on the west side of Manhattan even during the Marathon. NY handles large crowds very well and it should not be a problem(famous last words is you never really know) . leave early and give your self plenty of time.

The Breast cancer walk in NYC is in October.

I can't find anything that would disrupt Mothers Day traffic in NYC(except me)...

  17. We were diverted from Bermuda to Canada in September a number of years ago..needless to say some people were NOT happy. Canada although not freezing was not beach weather. I actually on one of the days we were in Canada went to the beach. I put my foot in the water and my leg froze...almost. It was way to cold to swim although some people swim in December in Coney Island(the polar bear club) but not me. Other than that we had a great time. I had always wanted to go to Halifax and that was my chance and I have been back twice since then voluntarily.

This was on NCL and at the same time a Celebrity ship also went the same way. Some of the passengers got so agitated with the Captain that he was going to Canada that he refused to let them board. Celebrity at first refused to refund the fare but X has a guarantee that if you are unhappy that you can get off at the first foreign port and get a refund. a small number of passengers did that. I don't know if the refused boarding passengers were refunded but I heard that they were eventually.

As I said we had a great time but I knew before we got to the pier we weren't going to Bermuda and some passengers who had flown in from far away places for a Bermuda vacation were much more disappointed but that is life. IMO.

BTW I have also been to Bermuda four or five times as well. Its easy from NYC

  18. those who know don't post here.

Here is the job listing for a MD aboard NCL.

also its not the cost of evacuation from the ship that is expensive. The US Coast Guard does NOT charge for a ship board evacuation.

Every country that I have spoken to about this(about 10) doesn't either. Most countries Coast Guard don't have the capability and its done by their military. It is expensive however if you wind up in some third world's country hospital to get evacuated back to the US. While sometimes its only the cost of a airplane ticket sometimes it the cost of a specialized plane and crew to bring you back. see for example http://www.angelmedflight.com

Also I was a part owner of On-Call International a travel assistance program and we never saw(to my knowledge) a bill from a company for a ship board evacutation to a hospital on shore by helicopter.
