Though the bullet that killed Chapparro, a .38 caliber, did not come from the 9mm gun that Tyson allegedly used in the shootout, he was still charged with her murder because he fired first and caused the ensuing gunfight in which she died.

 

The article reads like it prosecuted an innocent man for shooting the victim ?

Actually if the convicted perpetrator was involved in the gunfire, in most U.S. jurisdictions he is as guilty as the perp who actually fired the fatal shot.

 

Let us say you drive someone to buy some illicit drugs. In the course of the transaction, the dealer is killed. You are as much guilty of murder as the actual person who did the crime as you enabled the event to happen.

They had no choice but to convict him. If he did not shoot that poor girl tourist,

(during which this shootout caused her to be shot beacause he was firing his weapon)

 

You would never have heard of this and he would be walking the streets of st thomas.
