Charleston-Carnival Supreme Ruling. Is this battle now over??

Does this mean that this stupid lawsuit is over and Carnival can continue operating their cruises out of Charleston? Hope so! :D

The "down with Carnival" lawsuit is over, but the preservation groups also interfered with the port upgrade plans so the Army Corps of Engineers has to go through the whole approval process again. So in one respect, it's over, but the port upgrade process is still a mess.

No the battle goes on, the resident and preservation groups managed to get the permits for the new terminal pulled, because there was not an "impact" study done on what effect it would have on historic district. Apparently the residents in that area love all the rusting chain link fences acres of cracked asphalt, crumbling abandoned buildings.....almost everything around the cruise terminal is a complete eyesore. Charleston is a well preserved historic city, but don't be fooled most of it is a deteriorating eyesore that you would not want to be caught in after dark, just drive a block or two out of the "historic district" and you will see what I mean in the north they call them slums. Don't walk and lock your doors.

We love Charleston, so I hope they continue to sail from there. I do wish a newer ship would be put there though and sail on some different itineraries, because then we would consider booking a cruise from the city. We have already done the Nassau/Freeport thing and are looking to sail to different islands.

No. They can ask the court to reconsider. They can try to raise a federal issue (very unlikely). Most promising would be to refile from the beginning, concentrating on the issue the Supreme Court has raised: injury to their organizations. By then, the impact statement may be issued, which could help establish their injury claim.

 

Ain't the American judicial system great.
