crazycruzer68 Posted February 4, 2009 #1 Share Posted February 4, 2009 Not sure if this is the place to ask but I will start here, I am a divorced mother of a child under the age of 16, I have court ordered sole custody of her. Question is, do I need her father to be present when I apply for the passport or will my custody papers be enough???
rcandv Posted February 4, 2009 #2 Share Posted February 4, 2009 According to the Dept. of State, if you have sole custody, then you should be ok to get a passport for your child without your ex-spouse's approval. (be sure to have a certified copy of the order. It's always best). See the link below. However, it is always a good idea to check with your local processing office. http://www.travel.state.gov/passport/get/minors/minors_834.html
PINEVIEW01 Posted February 4, 2009 #3 Share Posted February 4, 2009 You will not need him. I took the order with me when I got mine I don't remember them taking it but, I didn't have any problems getting them
cherylandtk Posted February 4, 2009 #4 Share Posted February 4, 2009 I presume you have sole legal custody, not just sole physical custody. If so, your papers will be all you need. (Sole legal custody means the father's rights have been terminated.)
