Who's upkeep? The men at the port do not live, eat, etc. at the port or on the ship. They live near the port. They are trained how to handle every thing when a ship arrives and leaves port. Unfortunately, the tort laws of other countries are not like those in the US. There may not hve been a legal requirement to fix the hole. Even if you are only thinking about protecting somebody else from your plight by getting the hazard fixed, you would do well to speak to a lawyer in the Bahamas or at least one who is familiar with Bahamanian law.
