So, I do not believe it is correct to refer to the PVSA fleet  as though they are  a maritime organization.

 

They have no authority,  no command structure,  no headquarters,  no mission,  no dues,  no charter.

 

It seems like 'PVSA fleet'  is a figment of something.   

 

How could this figment be used as an argument to not change the act?

I think the only "figments" here are yours.  How is the total group of a nation's merchant ships referred to?  Gee, I think it is the "US merchant fleet".  Perhaps you've heard that term?  Does this fleet have any "authority", any "command structure", any "headquarters", any "mission", any "dues" or any "charter"?  Does any nation's merchant fleet have any of these?  Or maybe you call them something else.  After all, they are merely a collection of privately owned and operated vessels that only have the common distinction of flying their nation's flag.

 

You might even want to look up a definition of fleet.  For instance, from the Oxford English dictionary:

 

"a group of ships sailing together, engaged in the same activity, or under the same ownership.

"the small port supports a fishing fleet"" (italics and underline mine)

 

I'll bet that your hometown boasts of its "fishing fleet".  So, to answer your facetious question, the PVSA fleet consists of the hundreds of vessels engaged in the same activity (carrying passengers for hire within the US), be they ferries, water taxis, commuter boats, dinner cruises, sightseeing cruises, whale watching cruises, casino cruises, or large charter fishing boats.

 

If you knew anything about the topic, you'd already know all this.
