I made $$$ from my cabin pics!!

Actually I am not sure it was Steve that is the bad guy here as much as the people who submitted photos knowing they were not theres for money. Unless the guy searched the web and grabbed and posted, but if he admitted that I missed it.

 

Well I do not agree. First my email to him was that he had photos of mine without my persmission and I wanted them removed ASAP. He banned me. That alone shows ones character.

 

Also several have stepped forward when this thread was on the Carnival board and they were given credit for the photos when they sold them to this site. My photos were not given credit. If the person was not doing wrong then he would not have copped an attitude. Sorry you're not going to find sympathy for him with me!!!!

But there are protections against people taking intellectual property and using it for other purposes or in other places without permission. As has been mentioned, the copyright is automatic. Enforcement is another issue, but when someone does this, it is clearly against the law.
Here's the problem: The average American remembers the topic of PLAGARISM from high school English class. The average American understands fully that taking someone else's words is stealing, specifically plagarism.

 

However, the internet is still in its infancy and the average American isn't so clear on what constitutes fair use of material found on the internet. So people just do whatever they think is right (or, in some cases, whatever they can get away with). Until these things are more clearly defined and everyone is aware of the proper guidelines, we will have issues like this.

 

Personally, I wouldn't care if someone used my picture of an empty cabin (or even a cabin with my unidentifiable belongings in it), but I don't want anyone to "steal" pictures of my family; as such, I will not put them "out there" so I will not have a problem.

I have to say that my email to him was very direct and probably wasn't the nicest email. I basically said that the pictures were used with out my permission, I gave him 3 days to remove them and told him that I would contact his corporate office and CLIA if they were not done by that time. Since he is cooperating, I will not be contacting the people I mentioned.

 

I think the owner realized that what he did was wrong and realizes he really should cooperate and be responsive.

 

Coral, my email was far less threatening than yours but I have heard nothing in response. I simply said that I had discovered that he had posted some of my pictures on his site without my permission and that I wanted them removed. I was immediately blocked from the site and my pictures were removed. I guess he is being "nicer" to people whom he views to be a threat to him.

Yes, I gave him the name of each file that I found. I just right clicked on the picture, clicked properties, and copied and pasted the name into the email. I only found 2 pictures from our 2004 cruise - nothing from our 2005 cruise.

 

I am curious to know what all he has on the paid site. Is it possible that he has more unauthorized pictures there? I'm not about to pay to find out even I had not been banned from his site. I also wonder if he would have banned me if I had been a paid member?

Just a thought: I wonder if WebShots would take action against someone violating the terms of the WebShots website? Surely there is some way of tracking who downloads pictures. Cruisedeckplans.com should also have a record of who submits pictures to that site, if the "owner" did not do it himself.

That's how he got my photos. He copied them and downloaded them. He banned people who sent e-mails from site. That's my guess.

 

Webshots will do nothing as it is written in the disclaimer that it's up to the person posting them to realize they could be downloaded for other purposes. I have no issues with Webshots whatsoever.

Judy, I don't know about Webshots being able to do anything, since we agreed to make our albums public. I think it's more a matter of someone else doing something that is dishonest.

 

The funny thing about all of this is that it's a nice idea for a website (the cruise deck plans) and I had also used it in the past. I would have continued to use it, had he not banned me from it (which I still think is very childish). Heck, I might have even submitted my own photos that do NOT have my son in them. I even told him this in my email that I sent. I just did not like that someone else claimed my pictures and posted pictures that had my son in them without my permission (and got paid for it on top of all that!) I never even threatened him with lawsuits or contacting CLIA or anything like that. I just truthfully stated that I wanted those specific pictures removed because someone else submitted them as theirs, and that I would decide which of my pictures I would submit to him if I so choose to. (That I would submit pictures without my son in them.) I think that the way he is handling it with banning some of us is going to hurt him in the long run because as witnessed in this thread, news about it is already spreading fast. People who read these threads who otherwise might have done business with him in the future as a travel agent may think twice about it and choose to take their business somewhere else.

I also have no issues with WebShots. However, the person who downloaded the pictures and used them illegally is violating the WebShots user license. What is the purpose of having such a license if they do not enforce it? Or is it just a cast of CYA?

Perhaps he is thinking that he has lost you as a potential customer, so therefore he doesn't want to pay for the bandwidth for you to even look at his site. I guess that would make good business sense... but sounds an awful lot like the kid who gets mad and storms off with his football because nobody wants to play with his rules.

You were able to find the shots you took related to cruising on this one web site - how many other websites might have acquired (sp?) your pictures? The ones that contain pictures of you, or worse, your kids?

 

That cute photo of your toddler running around in the bathing suit that is falling off their bottom, or your teenager lounging on a beach chair in a skimpy bathing suit, you in that slinky dress making eyes at your husband . . . .

 

Every time you post on the internet, you open pictures, diaries, blogs, so much personal info that you are not aware of, to EVERYONE who has access to the web - not just the "good people" and the people you intended to see them. Not everyone who uses the internet is "nice" or "plays fair."

Wow! If I obsessed about this all the time I wouldn't even turn on my computer or go online, much less post pictures. I guess I don't post pictures that might be used out of context for "evil" purposes (which you imply in your message). I don't mind people downloading my pictures from Webshots (I have had over 600 downloads so far). However, when they post them on their own website and claim them as their own, I get upset.:mad:

 

BTW, I'm not flaming you. I understand what you are saying but I am willing to take the chance when sharing pictures on the web. If one day I see one of my pictures on the cover of some magazine somewhere you can bet that I will be hunting down the thief to get my money!:rolleyes:

I would like to find pics of my cabin on webshots. Is there an easy way to do that without looking through all of the pics for my ship? iI tried by searching for the name of the ship and the cabin number, but it did not seem to narrow down the pics. It showed all pics of that ship and i just wanted the aft balcony shots on the Rhapsody. Any suggestions would be appreciated. Thanks.

Hey. I hate to be the one to mention this, but if your teenager is lounging about on a public beach or by a public pool and they are wearing a skimpy swimsuit, guys are going to be looking. (We are talking about a female teenager wearing a skimpy suit, right?) Anyway, my point is that if you are worried about your teenager ending up on some smut site because of wearing a skimpy swimsuit, then you might want to consider talking to your teenager about having a little modesty and covering up some.

 

What's that? You don't feel that they should have to cover up some? Well, then when their picture is taken by someone else (yes, other people have cameras too, you know) and ends up on a pay site, don't say I didn't try to warn you.

Don't worry - I didn't take it as a flame... I'm just trying to remind people how easily their pictures can be taken and used by others... What webshots and whatever this other website has done is just mild... If you've followed the explosion of child/adult porn on the web and everything that is being discussed but politicians and across the news media lately, you'll see person after person expressing disbelieve at what people do with photos, the internet and other technology.

 

And no, I am not obsessed, nor am I paranoid about this, but I do have friend who work in an industry that have seen people manipulate photos in the most fascinating ways - it's so easy to take your picture and change bodies, heads, background.

 

Remember the Alyssa Milano dirty pictures scandal??
