$110 million dollars is a lot of money, NCLH just got hammered in court.

The last line of that article says:  "In 2020 a judge had ruled in favor of Carnival Corporation in a similar case."

 

Sounds like grounds for appeal to me.

Sounds like two different judges reviewing two different sets of facts came to different conclusions.  We will see if they appeal.  Either way that's a bad day in court.

From what I understand about this case the finding was for use of the pier after the cruise lines were notified and the owners property claim was certified U.S Justice Departments Foreign Claims Settlement Commission.

 

The cruise lines including NCLH, CCL and RCL owned lines continued to use the pier and as a result there was over 400 million awarded against the multiple companies.

 

The law passed in 2019 allows triple damages to be awarded.  Thus leading to the size of the awards.

looks like Carnival, Royal and MSC all lost.

Different cases dealing with different property and claimants.  In the case decided in Carnivals favor it appears that the plaintive may had acquired the claim to the property after 1996 which would make them not eligible for damages. In the recent case the plaintive has a documented claim established before that date and thus eligible for damages.  Thus the difference in rulings even though both dealt with Property confiscated by the Cuban government.
