Hopefully, I won't get into trouble for answering on this thread, but here goes. While most folks on CC feel that the PVSA only applies to cruise ships, it's reach goes much farther than that. And if you look at Wikipedia, their explanation of the PVSA as a protectionist piece of legislation does not do justice to its origins in the Steamboat Act of 1852, designed to protect the public from the rash of steamboat explosions and fires at the time. The PVSA applies not only to cruise vessels, but to every vessel that carries passengers either between two US ports, or within US ports and inland waterways. So, the act requires all these "domestic" or "coastwise" vessels; ferries, commuter boats, water taxis, sightseeing or whale watching boats, dinner excursion boats, casino boats, and large charter fishing vessels, to be US built, US registered (flagged), and US crewed. This not only protects US jobs in shipbuilding and vessel operation, but places the vessels under the stricter US labor laws, environmental laws, accessibility laws, and USCG registration, safety, and training requirements than they would be under if allowed to be foreign flag. Yes, Princess could be fined for this, because she transported passengers from one US port to another (open jaw cruise), without calling at a distant foreign port, but if she hadn't had this problem, and returned all the passengers to the port of origin (closed loop cruise), but couldn't dock in Ensenada (their one foreign port) due to weather, she would also have been in violation. However, as I've stated, waivers for the PVSA are routinely given for missed ports due to mechanical failure or weather. Whether or not this would have happened if the ship were US flag is trying to prove a negative. Are regulations for US flag vessels stricter? Yes. Do equipment failures and operational errors still occur on US flag vessels? Yes. Would this have been prevented simply by being US flag? Impossible to determine. I was familiar with PVSA and pretty sure in an emergency they waive the fine. We have a boat and there are getting to be as many rules as there are for Aircraft and Pilots. Must be quite a change for you after being in Key West for so long. Back on topic, I really wish cruise ships would waive the PVSA fees for emergencies like that. I suppose they do some of the time, but it would be nice if they were more consistent. I had to deal with contractors on the Coral Princess when we were in Alaska. It definitely affected the cruise in a negative way. We didn't have hot water most of the week (lukewarm at best the first five days) because they were swapping out most of the pipes taking water to the cabins on a couple decks. One day in port we came out of our cabin to see water dripping from the ceiling into large trash cans all the way down the hall, ladders all the way down the hall, and numerous men in overalls with the company name on them all the way down the hall. We had to squeeze past all this to get to the stairs. We returned from shore later to discover that the mess was still there. The contractors stayed with us until at least the end of the cruise - I saw them again on the final sea day. Some of the carpets in the hallway were still damp when we left - I could tell because they still had fans blowing in the halls. I can't imagine what it would be like immediately before or after a dry dock. And you paid big bucks stepping around contractors, having lukewarm water, and soggy carpet. This is not right. I'm sure Princess would have said there was a major leak and an emergency when in fact they wanted to be ahead of the schedule and replace pipes then. I saw the same thing on the Coral, but the pipes were being replaced on the outside of the ship on the Promenade deck. Sometimes I think Princess takes advantage of the customer, and if they complain they get a cheap bottle of champagne sent to their cabin.:rolleyes: Link to comment Share on other sites More sharing options...

I know Princess won't cancel the drydock so its seems to me the next cruise will be impacted one way or another.... Rare Coral Posted December 7, 2016 #416 Share Posted December 7, 2016 (edited) I doubt the ship will be fined. Sometimes in Alaska, the ship doesn't always make it to Victoria. I hear that the ship stops in the water, Victoria individuals come up to the ship and papers are signed and no one is fined. This happened on a cruise of mine where we missed Victoria and had no other foreign port. I am guessing there is some provision that takes into account if a ship is physically unable to make it to the port. My cruise buddy texted me this morning, stating the ship was leaving for Portland as soon as all the passengers disembarked. Everybody was getting off by 10am, so the Grand could leave Honolulu.
