When did Margaritaville become a specialty on Escape?

The problem with US law overall is it DOES allow you to sign away a lot of protections you might otherwise have, and the lawyers know this. They also know no one reads the fine print. For the most part, the only protections you cannot opt out of are discriminatory behavior and safety regulations.

 

Let's face it, if there was really a case here, some of the more aggressive 'maritime' lawyers would be all over it.

 

Changes to the terms of the contract may be material (goes to the heart of the deal) or not. Material changes would give rise to the ability for the injured party to repudiate the contract. A non-material change would give rise to damages (rough paraphrase of UK contract law based on lessons from 30 years ago and a few malt whiskys tonight:D).

 

The point is that NCL are probably sailing close to the wind (sorry, couldn't resist that:D) with US contract law and are pretty much ignoring EU contract law, with all of their shenanigans with added charges.

 

They are banking on the fact that no-one will sue them based on one change as it is, on its own, a trivial issue.

 

Whilst NCL continue to treat their customers in this disrepectful, immoral manner, I am highly unlikely to do business with them - I do not trust them to deliver what I sign up to.

Loss of a free burger is unlikely to produce enough of a payoff for the 'aggressive maritime lawyers' to get out of bed for - NCL have worked that one out IMHO.

I don't think the EU contract has the prescription from joining a class action like the US does (which is, BTW, the part of the US contract I think would be most likely to be overturned.)

 

For those who are not aware, the US T+C preclude you from joining a class action against the line, nor suing in any other venue but small claims (arbitration required which almost always favors the business)

This pretty much sums up the issue in very few words. Too many people on this thread just don't understand and keep trying to cloud the issue.

 

Note to the ever vigilant NCL defenders, just try to keep this simple phrase in mind when trying to understand the root issue, "BAIT AND SWITCH." If that doesn't help, you might also try "NOT AS ADVERTISED" :rolleyes:

And for the person saying the burgers are the same all I can say to this is I had both and the burger in the buffet to me were better. Could be how they were cooked? I don't have the answer. We had Margaritaville complimentary. And if it was not complimentary when we went I would have been furious too since I made my final payment back in April. And to change something like that, which is a big deal that now a family of 4 will have to pay around $60 for something they were supposed to get for free, is jut terrible business practice. Totally Bait and Switch.

Amazing all these changes going on on NCL Escape. I leave in two weeks and have not had one correspondence with NCL concerning any of these changes. I don't know what's complimentary , a la carte, speciality , shows available lTried 2 months ago to make all reservations for 9. Not successful and hope to have better luck when on board. Looks like it' may be be a very frustrating week.

call NCL. they can do your reservations over the phone and answer your questions, like "what's complimentary?" even if you used travel agent.

I'm pretty sure someone has answered this, but I really don't have time to go back to the beginning to read all the post! :o If I bought the Ultimate Dining Plan before you had to start paying at Margaritaville, can I still eat there in the daytime for free or do I pay? I might never eat there, but I was just wondering! Thanks

Its easy, go online, login and make a reservation or review options both pay and complementary. No need for frustration.

I posted today that after 1 week neither Jean who contacted me from the Executive Resolutions Department, or the SVP who gave another member complimentary meals, has responded to my email.

 

That post has gone missing. I plan to continue to post updates on if I receive any response from NCL. I take the word over a stranger / forum member than I do over their exec office at this point.

Given a choice, we always skip the dining option for Margaritaville on land - even when it's just using our casino comp's in AC (NJ) - really don't matter whether it's price-fixed or a la carte, and, would most definitely not paid or bother using OBC (from TA's) for the upcharge, whether it's on the Escape or other *Away/Plus class ships coming soon.

 

Just reading a post about burgers not available at all on the STAR's buffet, not at all ... how interesting. Can't be serious, right ! Just kidding, I hope.

 

Not about to connect the dots, yet.

 

Hotdogs on a cruise, anyone. :D

More than close in UK law - they are on sticky wicket (UK term for in trouble) There is a good chance the contract would be voidable if they were challenged. This is not maritime law. It is UK consumer law and it very biased to the customer

Please post any update you get. We are contacting NCL now for our March 12, 2016 voyage which we booked in March 2015. Margaritaville was a big draw for us too.

 

Will the UBP be honoured at the restaurant still?

Did Royal Carribean give future notice that a fee would be charged for Johnny Rockets after it was advertised as free? I really don't recall. The flat cover charge that Royal charges seems to be much easier to digest than the fee for each item you order in Margaritaville on NCL though.

I did get a call back today from the executive guest relations office. They informed me there has been no further change to their policies. The guy had trouble getting through the scripted card.

 

I asked about the email that was posted here by another user. He said the SVP office will not be responding to any further requests and he can't get me an answer on that. He said I should try emailing directly. I do so the SVP a week ago as well as to Mr. Del Rio's office without any response.

 

I asked why some people were chosen to be comped a meal and others were not. He said he could not answer that.

 

I asked if we could expect a reduction in cruise fare. He could not answer that.

 

I asked if I were ever going to be notified by NCL of the new charge. He said I already knew about the charge so why does it matter. When pressed he said I would likely not be receiving notification of the charge before my cruise.

 

It was as useful as an icemaker to an Eskimo.

 

I feel bad for these Executive Guest Relations / Resolutions Specialists. they are just phone operators that read off a script. No ability to resolve anything.

Sounds like a quote many posters to this board would use to justify NCL'S position.
