I used to sail a 22 ft sailboat on the Chesapeake Bay.  In theory, if I was under sail, I had the right of way.  However, when there was a large freighter and me, I avoided him regardless of what the right of way rules might say.

You may want to refresh your memory of COLREGs 8 and 9 (particularly 9b).

Nautical charts feature a 'COLREGS demarcation line' indicting where the rules change.

I guess that is what you might also call the "common sense rule".  We always followed it in spite of the fact that I did not know that the exact rule existed.

it is up to the courts to decide which rule takes precedence .....

 

YOU might think the answer is OBVIOUS but this may NOT be the path the courts have taken ......
