RCI only has Freedom scheduled for test cruise in June. Each ship has to have a test cruise unless they are going with 95/98% vaccinated passengers/crew. And I don't think that is the case according to Richard Fain. Not likely all of those ships will sail on those dates. I am wondering if once the initial test cruise is complete and they can obtain "proof of concept" that they will only require each cruise line to do one test cruise. Companies that violate this law would be subject to a fine of $5,000 each time they require a customer to present a 'vaccine passport' for service." No one really knows. Not in the industry, nor even the Governor himself. OK, that's a bit misleading. The problem really is that: 1. Yes the Governor (and legislature) can regulate business in their state BUT 2. The countries on the itinerary can require vaccination (or deny entry to the entire ship if vaccination is not required) AND 3. The CDC is asserting jurisdiction here through the Commerce clause of the Constitution. Since the port is manned/staffed by Coast Guard, Customs, and Immigration it's clear that some Federal jurisdiction applies The real question that no one can yet answer is does the CDC supersede Florida in this instance? That's for courts to figure out (if it gets that far). It also all could become moot if cases/hospitalizations/deaths continue to drop and all restrictions are removed. The case that was filed by Florida (and joined by Alaska and Texas) - Farmer v Book has been ordered to mediation which must take place by June 1st, per the court (so very soon). But the mediation might not have any outcome (in other words, it could go back to the court). If that happens it could take a while to resolve things. The judge already denied lifting the rules before sending them to mediation. And, even if the judge where to say summarily rule that the current rules be lifted immediately (highly unlikely, given he already refused to do so) it could be appealed and stayed. In other words, if mediation doesn't work the case could drag on for months. We haven't heard anything about the mediation yet, either, and we're headed into a holiday weekend.
